If I’m on a public street in Atlanta and wreck on my bicycle and rip off my nose can I sue the city?
I had my helmet on. Or maybe can I sue the helmet manufacturer? someone has to pay and its not going to be me.
it depends on what caused the crash:
Was it a speed bump(especially if it is the only one that is not painted)?
Was it a rain grate that your wheel fell into?
The two above could be grounds to sue and win a lawsuit(i Did with the first one)
Pot holes in the road: this depends on whether someone has previously contacted the city about repairing the pothole.
sliding on the road surface(road Paint, etc) ? not likely
You will not be able to sue the helmet company. this is for two reasons:
1 when you bought the helmet(and it was in the box) it included papers that state that they are not responsible for actions of other(ie. YOU) and that the helmet was designed to protect the HEAD(not the Nose)
2 the helmet did its job(that is protecting your brain)
